The Youth Justice Act 1992 allows for confidential information to be shared between government and non-government organisations in a range of circumstances, including collaborative case management.

We have developed a cross-agency memorandum of understanding and arrangement (MOU) (PDF, 2.1MB) or (DOCX, 121KB). The MOU provides the way for information to be shared between organisations to:

  • coordinate services (including assessments and referrals) to meet the needs of children charged with offences
  • provide information the courts may use to make bail or sentencing decisions for children.

Becoming a service provider or prescribed entity under the arrangement

The Youth Justice Act 1992 also allows for additional organisations to be part of the collaborative information sharing to meet the needs of children charged with offences by becoming service providers or prescribed entities under the arrangement.

Service providers

Organisations who can become service providers are:

  • Legal Aid Queensland, established under the Legal Aid Queensland Act 1997
  • a non-government organisation that provides a service to children.

Examples of services that may be provided to children include:

  • counselling
  • disability services
  • education or training services
  • health services
  • housing and homelessness services
  • legal services.

Prescribed entities

Government agencies who can become prescribed entities are:

  • departments that are mainly responsible for any of the following
    • Aboriginal and Torres Strait Islander services
    • child protection services
    • community services
    • corrective services
    • court services
    • disability services
    • education
    • housing services
    • public health services
    • youth justice services
  • another department that provides services to children
  • the commissioner of the police service
  • the chief executive officer of Mater Misericordiae Ltd (ACN 096 708 922)
  • a health chief executive officer under the Hospital and Health Boards Act 2011
  • the chief executive officer of the National Disability Insurance Agency
  • the principal of an accredited school under the Education (Accreditation of Non-State Schools) Act 2017
  • the public guardian
  • or
  • another entity prescribed by regulation.

Organisations contributing to multi-agency collaborative panels

Once service providers and prescribed entities have completed the relevant forms, they may also contribute to the operation of the multi-agency collaborative panels system by invitation of the core members.
